It's the 46th Anniversary and May 1st, 2nd, and 3rd will be bigger and better than ever.

The Isle of Eight Flags Shrimp Festival features Fine Arts & Crafts, Antiques & Collectibles, Southwest Airlines Kids Korner and Live Entertainment from two stages, and dozens of food booths featuring scrumptious shrimp specialties.
Each year, the Festival is held the first weekend in May in the Historic downtown Centre Street business district in Fernandina Beach on Amelia Island, Florida.
It all kicks off with the Pirate Parade. Known as one of the highlights of each year's festival, the Pirate Parade will begin at about 6:00 PM on Thursday, April 30th, 2009 and will last until the final float rolls up Centre Street. This year, the theme for the parade is "Home Grown Shrimp, the Pick of the Litter."

CH to host Habitat event
Cumberland Harbour will once again host Habitat for Humanity of Camden County's spring charity event April 18 at the Poolside Pavillion. This year's theme is "Treasure Island." Food, dancing and entertainment will be featured from 6:30 pm until midnight.
A live auction will be held. Items include a golf package, hotel getaways, salon and day spa treatments, small business advertising packages, and dinners at local restaurants.
Cost is $25 person -- Cash bar -- Pirate attire encouraged

CH's Buddy Mays receives awardSecuritas supervisor Buddy Mays receives Supervisor of the Month award from Securitas Branch Manager Patrick Maginnis, for Buddy's supervision of the Cumberland Harbour gatehouse operation. Maginnis said Buddy deserved the award for his attention to detail, effective scheduling and communications skills. Also pictured is CH property manager Jeanette Jones.

Spring Celebration and Easter Egg HuntCumberland Harbour residents, owners and guests gathered for a Spring Celebration Cookout on Saturday, April 5, at the Landings common area. After a week of heavy rain, Saturday’s weather for the event was a perfect, sunny day. Children enjoyed a variety of activities, including an Easter egg hunt and a piñata. Hot dogs and hamburgers with all the fixings were served. Bunny cupcakes baked by Rita Bruce were for dessert.

Cumberland Island Annual Horse CountThe 2009 Annual Horse Count takes place this weekend, Mar. 20-22, at Cumberland Island. The annual census utilizes volunteers from around the country, including many students. Cumberland Harbour residents Bernie & Mary Huber, National Park Service volunteers, also take part.
Though impossible to count virtually every horse, the census, by utilizing the same methods year to year, has developed over time a clear picture of horse population and health trends.
Volunteers gather for a review session Friday evening. Saturday entails counting in the northern part of the Island. Saturday night features the traditional Brats and Bubbas Barbeque. The census finishes on Sunday, where counts are done in the south. Protocols employed allow the final tabulation to identify and exclude redundant counts (ie, same horse counted twice).
The existence of horses is not without some controversy. Horses are not native to the island, and environmentalists charge horses feed on and destroy sand dune plant life, which anchor the dunes and serve to protect the dunes and island from erosion. The Park Service has in this case decided to allow the horses to remain.

- Pay online at: aim-services.net. If you have not already registered for a username and password, you will need to do so prior to paying your bill online. If you have a username and password, you can pay your bill using the website.

CUMBERLAND HARBOUR PROPERTY OWNERS ASSOCIATION
Dear Fellow Lot Owners:
As the newly appointed Board of Directors of the Cumberland Harbour Property Owners Association, we would like to give everyone a brief update on where the community stands at this time.
As most of you are aware, Land Resource filed for a Chapter 11 bankruptcy last October. The bankruptcy process has been ongoing and recent activity involved the liquidation of their assets. This liquidation resulted in the communities which were under development being offered at auction with a plan to sell them to the highest bidder. The bank holding the main mortgage on Cumberland Harbour did not accept the highest bid and ended up taking back the community itself with plans to continue to market and eventually sell the community for a price they feel is more equitable.
As part of the review of the current issue with the bankruptcy, the Board of Directors met with the association’s legal counsel to discuss filing a claim with the bankruptcy court to secure the common areas and facilities on behalf of the association and its members. The Board did authorize this filing and as further information becomes available, it will be communicated to you, the lot owners.
Also, as reported earlier, the Supreme Court of Georgia overturned the lower court ruling prohibiting the building of the marina so we are hopeful that once a new developer comes forward to purchase the community, we will also see plans for the marina to be built.
The City of St. Mary’s is pursuing the release of the bond money to finish the roads and infrastructure in the community. At this time the bond company has had their own engineer out to look at the community to determine his estimate of the work still needed to be done. The City will seek proposals from sound, responsible companies based on the engineer’s plan of work and, provide them to the Bond company. We hope to see work begin on this sometime in the next several months, but there has been no schedule set for the work at this time.
The Board has met to review the financial status of the association. A hard look was taken at the delinquencies in the payment of the homeowners assessments. The Board has instructed management to work with George Nowack, the association’s legal counsel, to take further action to collect the outstanding balances.
It was the decision of the Board to keep the 2008 budget in place with the fees at the same level for 2009. The Board will be working with management on keeping expenses down where possible while not affecting the quality of service provided. We feel that a renewed collection effort combined with a close eye on expenses should enable us to weather the current economy. (A copy of the budget is available here!)
Also, the Board has been working with our manager, Jeanette Jones, in having repairs done to the common area buildings where needed. The Pool House was in need of replacement of some exterior sheathing that water had penetrated, the Spring House required replacement of some rotted wood and, the Fitness Center had a leak in the roof.
Plans for the very near future include review of proposals for insurance coverage for the association as well as to perform the audit recommended by AIM Services as discussed at the annual meeting.
The Board would also like to report that the Design Review Board has been busy reviewing new submittals for home construction in the community and in the past few months, they have given approval for four new houses to be constructed. Several of these have already begun work and we should have new neighbors in these homes within the year.

We have also set up a separate email for individual concerns or questions for the Board of Directors at: Boardchpoa@aol.com. New CH Exit Gate Closed Hours
CH Gatehouse outbound gates will be maintained in the closed or lowered position from the hours of 11pm to 6am, every day, including Saturday, Sundays and holidays.
Owners with CH bar code stickers on vehicles will be able to pass through without stopping by driving past the outbound gate card reader. Those without stickers will need to stop and sign out with CH security personnel during those hours.
Outbound gates will be maintained in the raised or open position from 6am until 11pm daily.

Harbour Lights has received an unconfirmed report about yesterday's Land Resource's bankruptcy hearing in Orlando.
It appears 6 Land Resource properties are to be sold to buyers pursuant to a bidding process set up in the Ch. 11 Reorganization case. Closing on those purchases is scheduled for Feb. 6.
Cumberland Harbour and Grey Rock at Lake Lure were the 2 LR properties not sold yesterday.
Three properties, Bridge Pointe at Jekyll Sound (Waverly, GA, Camden County), Villages at Norris Lake (La Follette, TN), and Wild Ridges at Morgan Creek (Marion, NC), have apparently been purchased by a single company, the "Emerson Group."
The possible sale of Grey Rock in parcels to creditors and owners is still being worked out.
Harbour Lights has learned interest in Land Resource's unsold Cumberland Harbour lots & marina was high; however, none of the bids submitted by prospective purchasers rose to the minimum level set by the creditor banks. As such, Cumberland Harbour was not sold but is being retained by the banks for the time being, which felt more money could be obtained if they had more time.
It's also reported that currently, the unsold LR lots, marina permit, and land set aside for the marina & yacht club, are being shopped together as a single piece. That could change, however, if selling them separately would bring more money.
Harbour Lights will have further news of the bankruptcy proceeding as it becomes available.

New slate of directors for CHPOA Board
Pursuant to the announcement made at the Cumberland Harbour Property Owners Association ("CHPOA") annual meeting held Nov. 8, 2008, that the Declarant, Point Peter, LLC, a subsidiary of Land Resources, LLC, would appoint new directors to the CHPOA Board, and once the newly appointed directors had been installed, the then existing directors would resign, the following lot owners have been appointed and installed as directors of the CHPOA Board by Point Peter, LLC:

Stan Smith, Vice President
Don Robertson, Secretary/Treasurer
The two then existing CHPOA board members, who were employees of Declarant and/or Land Resources, LLC, John Alvarez and Mark Rogers, have resigned.
The Declarant, Point Peter, LLC, had solicited applications from anyone interested in volunteering for the board. The number of applications received reportedly was just under 20.

Welcome to new CH security company
We wish to welcome our new security company, SECURITAS, which began work on January 1st. A decision was made to change contractors following receipt of competitive bids and a careful review. The new security company offers better service at a lower cost for the community.
We also wish to welcome back Buddy Mays. Many of you may remember Buddy as the smiling gentleman who used to work the day hours at the gate, and we are very happy to have him back on board!
For vehicle passes, key fobs and other services from the gatehouse, there are two ways to contact them:

Repair to CH key fob system
The key fob system, used to access the amenity buildings in the community, is in the process of being repaired. The contractor has been out to do a complete check-up on the system, and all automatic locks are now working with the exception of the fitness center. The lock on the door to the fitness center is broken and will be replaced in the next week.
If you need a key to access the fitness center, you can obtain one at the gatehouse. We will issue a notice as soon as the lock has been replaced alerting everyone their key fobs will once again work.

St. Marys Boaters Thanksgiving
Several hundred sailboating 'cruisers' once again made St. Marys their Thanksgiving port of call. Visiting boaters enjoyed a warm, sunny day with the traditional 11:00 a.m. oyster roast and Thanksgiving dinner served at the Riverside Hotel at 1:00 p.m.
As in the past, volunteer residents of St. Marys contributed by providing the turkey and baked ham main course dishes.

We note with sorrow the recent death of our neighbor Clem Sansone. Clem and Jeanne's house on Plank Lane was one of the first built in Cumberland Harbour. The following obituary appeared in the November 5th edition of the Atlanta Journal-Constitution:
SANSONE, Clement -- Mr. Clement A. Sansone, age 56, of Decatur died Sunday, November 2, 2008. He first worked for Scottish Rite, then at the Atlanta Outpatient Surgery Center where he became director, and then as the CEO of the Northlake Surgery Center until he retired in 2007. Mr. Sansone is survived by his wife, Jeanne Sansone; sons, Brian and John Sansone; parents Clement & Norma Sansone; sister, Gilda DiPasquale; nephew, Kristoffer DiPasquale; sister-in-law, Susan Bennett and her husband David; and nephew, Davis Bennett. Funeral services will be held on Thursday, November 6, at 10:00 am at the First Baptist Church of Decatur, with Julie Pennington-Russell officiating. Interment will be at Decatur Cemetery. Those desiring may send contributions to the American Cancer Society or to the National Kidney Foundation. The family will receive friends from 5 to 8 pm Wednesday evening at A. S. Turner & Sons.

Supreme Court affirms the DNR interpretation of the Coastal Marshlands Protection Act

ATLANTA (Nov. 17, 2008) - In an action involving a marina permit issued to Land Resource and Point Peter, LLC, the developer of residential resort community Cumberland Harbour, the Georgia Supreme Court upheld a lower court's ruling that the Coastal Marshland Protection Act does not extend to the upland portion of a development. Instead, the Supreme Court has agreed with the Department of Natural Resources' long-standing interpretation that the Act is directed at the regulation of coastal marshlands, which are defined by the General Assembly in a manner that does not include upland areas.
As a result of the 5-2 decision written by Justice Hines and released on November 17, the Cumberland Harbour marina permitting process may proceed.
"We are pleased with the Court's decision and look forward to working with the DNR and Army Corps of Engineers to finalize our permits so the residents of St. Marys and Cumberland Harbour can finally get the marina they deserve," stated J. Robert Ward, CEO and President of Land Resource.
The Court based its decision on the language of the Coastal Marshlands Protection Act, confirmed in the rules adopted by the Board of Natural Resources. The Court resoundingly rejected the notion that the General Assembly intended to establish the Coastal Marshlands Protection Committee (CMPC) as the "super regulator" of any and all development in the coastal areas of the State.
Before actual construction of the marina can begin at Cumberland Harbour, the company must finalize the Biological Assessment, as well as obtain the final permit from the CMPC, in order to receive the permit that is required from the U.S. Army Corps of Engineers.
